Commission Terms & Conditions

Terms & Conditions for Commissions by
Mali Morgenstern AKA Sterny Design

1. All commissioned artwork is my own intellectual property and I retain the right to use it as I would any other work of mine. This includes but is not limited to; posting online, printing, editing, and inclusion in my portfolio.

2. I will never share any personal details about my client(s) without permission.

3. The client(s) is allowed to share the artwork online*, print it in any form, and use it as an asset in any non-commercial context. The client(s) is not allowed to sell the artwork in any form or otherwise profit from it.

3a. *The client(s) must credit me under one or both of the following names: Sterny Design, Mali Morgenstern. A credit of my username on the relevant platform is preferred when posting the artwork online.

3b. If the client(s) commissions a new artwork (from a different artist) of my original design, I must be credited as the designer (following above crediting guidelines) in any online post of the new artwork.

4. The client(s) agrees to disclose if any aspect, reference, or inspiration of their request may be copywritten, inspired from another artist, an intellectual property, or has an offensive/discriminatory/hateful meaning. If the client(s) fails to inform me of the relevant information, I hold no responsibility for the possible consequences.

5. I retain the right to terminate the commission process at any time if the client(s) has violated any of these terms or has done anything to cause sufficient damage to the client artist relationship. My refund policy is unaffected by termination.

5a. The client(s) retains the right to terminate the commission process anytime before payment. After any payment has been made, partial or full, termination is still permitted but a refund may or may not be offered (see refund policy below). 

5b. Generally I will request the full commission payment upfront, in this case refunds may only be offered if no substantial work* has been completed yet.

If payment is split into one half upfront and one half upon completion, refunds of the first half of payment may only be offered if no substantial work* has been completed. Refunds of the second half of payment and/or the entire sum will never be offered.

5c. *I determine what qualifies as “substantial work”.

6. My commission prices are subject to change at any time, this includes the possibility that the price of an ongoing commission may change.

7. Revisions, printing, technical and processing services, additions, and other such things may increase the price of an ongoing commission. These extra costs will be paid as they come up during the process. Refunds of these additional costs will never be offered.

8. All commissioned artwork is created by me and no part of the process knowingly uses generative AI. Many digital programs have built in AI features and tools, but I will never purposefully use any generative AI in my process.

8a. The client(s) is not allowed to use my artwork to train generative AI models, or feed it into any generative AI model for any purpose.

9. I may offer an estimate on delivery time and when provided with deadlines I will do my best to meet them. That being said, there is never a 100% guarantee on delivery time. I work on commissions by priority level, meaning some commissions may sit “waiting” for some period of time before I begin working on them.

Paying for a commission only secures a place on my priority list, it never guarantees delivery time. My refund policy is unaffected by time taken to complete a commission.

10. All the terms and conditions outlined here are subject to be changed or added to, and individual commission circumstances may call for one time changes or additions.

10a. The client(s) is allowed to request revisions to these terms (before and or after agreeing to them), however I retain the right to deny such requests.

11. If any of the above terms and conditions are violated by someone other than my client(s) it is the clients' duty to attempt to the best of their ability to resolve the violation.

12. By commissioning and paying for this artwork the client(s) agrees to all terms and conditions outlined above. Refunds do not affect the binding of these conditions.

12a. These terms and conditions will be clearly presented to my client(s) and are always accessible on my website. These conditions apply and are binding regardless of the medium through which I am commissioned by the client.

Language clarifications:

"Client" refers to any person who has been involved in a commission process with me currently or in the past, whether payment has been received or not, unaffected by refunds or termination.

"Artwork" and "Commission" refer to any illustrative or design work created by me for the client. This includes variations, sketches, and scrapped versions.
